  • Post or share content within our platforms that is offensive, discriminatory, defamatory, or otherwise violates the community standards detailed in our Free Community Agreement.
  • Engage in any activity that Changing Courses 11 LLC deems unacceptable for the use of its site, products, or services. Changing Courses 11 LLC reserves the right to make such determinations at its sole discretion and take appropriate action.

5. Purchases and Payment

All purchases are governed by the payment terms outlined at the time of sale. Prices and terms are subject to change without prior notice. Payments are considered final unless otherwise stated in our refund policy, which can be reviewed on our website. By completing a purchase, you acknowledge and agree to these terms.


6. Refund Policy

11. Liability Waiver

Changing Courses 11 LLC is not liable for any damages, losses, or adverse outcomes resulting from the use or inability to use its services or products, except as required by applicable law. By engaging with our offerings, you acknowledge that the use of our resources is entirely at your own risk and discretion. It is your responsibility to evaluate the suitability of our services and tools for your individual needs and circumstances. This limitation of liability does not negate or conflict with the indemnification clause, which covers third-party claims against Changing Courses 11 LLC arising from user actions.

  8. Liability and Indemnification: Changing Courses 11 LLC is not responsible for device damage, data loss, or other issues arising from app usage. Users agree to indemnify and hold harmless Changing Courses 11 LLC for any third-party claims related to misuse or violations of these terms.

13. General Provisions

a. Amendments: Changing Courses 11 LLC reserves the right to modify, update, or entirely replace this Agreement at any time. Updates will be communicated through electronic means, such as email or our website, and will become effective the next business day after notification. By continuing to use our services, you signify your acceptance of any changes. If you do not agree with the updated terms, you may terminate your engagement per the terms outlined in this Agreement.

b. Applicable Law: This Agreement is governed by and construed under the laws of the State of Tennessee. Any legal actions arising from or related to this Agreement will be exclusively brought in the Circuit Court for Williamson County, Tennessee, or the United States District Court for the Middle District of Tennessee.

c. Dispute Resolution: Any disputes arising under this Agreement will first be subject to good-faith negotiation between the parties. If unresolved, the parties agree to mediation conducted in accordance with Tennessee Supreme Court Rule 31. Mediation will take place in Williamson County, Tennessee, within 30 days of a written request unless otherwise agreed upon. Costs of mediation will be shared equally. If the parties cannot agree on a mediator within 10 days, a court of competent jurisdiction will appoint a Rule 31 mediator.

d. Force Majeure: Neither party will be held liable for delays or failures in performance caused by circumstances beyond their reasonable control, including but not limited to natural disasters, government actions, internet outages, or pandemics. Both parties agree to take reasonable steps to minimize the impact of such events.

e. Severability: If any provision of this Agreement is deemed invalid or unenforceable, it will be replaced with a valid provision that most closely reflects the original intent. The remainder of the Agreement will continue in full force and effect.

f. Indemnification: Users agree to indemnify, defend, and hold harmless Changing Courses 11 LLC, including its officers, employees, agents, and affiliates, against any third-party claims, liabilities, or expenses arising from their actions, negligence, or breaches of this Agreement or applicable laws. This indemnification applies to actions directly impacting the company through third-party disputes and does not override the company's limitations on liability as outlined in the Liability Waiver. Users must obtain prior written consent from Changing Courses 11 LLC before entering into any settlement that imposes obligations on the company, including financial or reputational burdens.

g. Costs and Expenses: In the event Changing Courses 11 LLC initiates legal action to enforce the terms of this Agreement and prevails, the company is entitled to recover reasonable attorneyā€™s fees, expenses, and associated costs.

h. Notices: All notices must be delivered to the respective contact addresses listed below and will be deemed received upon delivery:

  • To Changing Courses 11 LLC: 725 Cool Springs Boulevard, Suite 600, Franklin, TN 37067.
  • To You: The email address or physical address you provided during registration.

i. Entire Agreement: This document constitutes the entire agreement between you and Changing Courses 11 LLC, superseding any prior agreements or understandings, whether written or oral, regarding the subject matter herein. Any proposed changes, amendments, or additional terms will not be considered binding unless explicitly agreed to in writing by both parties. This Agreement is intended to be comprehensive and definitive, and no external statements, representations, or agreements shall alter its terms.

j. Authority: Each party represents and warrants that it has the full power and authority to enter into this Agreement. This Agreement is binding and enforceable according to its terms. Users affirm they are of legal age and competent to agree to these terms.


14. Compliance with California Privacy Laws

In accordance with the California Consumer Privacy Act (CCPA), Changing Courses 11 LLC respects the privacy rights of California residents. We provide the rights to request access to, correction of, deletion of your personal data, and the right to opt-out of the sale of your personal data. Changing Courses 11 LLC does not sell personal information to third parties without explicit consent and complies with all other requirements set forth by California privacy laws, including registration and disclosures as a data broker.
